These Terms and Conditions ("Terms") govern your access to and use of Highclere Trust's platform, products, and services. By creating an account or using any of our services, you agree to be legally bound by these Terms. Please read them carefully before proceeding.

01 Acceptance of Terms

By accessing or using Highclere Trust's platform, products, or services, you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree with any part of these terms, you may not access or use our services. These terms apply to all users, including prospective clients, registered account holders, and authorised third parties.

02 Eligibility

To open an account and use our services, you must be at least 18 years of age, have the legal capacity to enter into binding contracts, and not be prohibited from receiving financial services under applicable law. By registering, you represent and warrant that all information you provide is accurate, current, and complete.

03 Account Responsibilities

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised access or suspected breach of security. Highclere Trust will not be liable for any loss arising from your failure to protect your account credentials.

04 Services & Investment Risk

Highclere Trust provides wealth management, investment, and financial planning services. All investments carry risk, including the possible loss of principal. Past performance is not indicative of future results. Nothing on our platform constitutes financial, legal, or tax advice. You should seek independent professional advice before making any investment decisions.

05 Fees & Charges

Our fee schedule is disclosed in your client agreement and may be updated from time to time with prior notice. Fees may include management fees, transaction fees, custodial fees, and performance fees depending on the services engaged. By continuing to use our services after a fee change, you accept the revised fee schedule.

06 Prohibited Conduct

You agree not to use our platform for any unlawful purpose, including money laundering, fraud, tax evasion, or the financing of terrorism. You may not attempt to gain unauthorised access to any part of our system, introduce malicious software, or interfere with the integrity or performance of our services. Violations may result in immediate account termination and referral to law enforcement.

07 Intellectual Property

All content on our platform, including but not limited to text, graphics, logos, software, and data, is the exclusive property of Highclere Trust or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our express written consent.

08 Limitation of Liability

To the fullest extent permitted by law, Highclere Trust shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including loss of profits, data, or goodwill. Our total liability to you for any claim shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

09 Termination

Either party may terminate the client relationship in accordance with the terms set out in your client agreement. We reserve the right to suspend or terminate your access to our platform immediately and without notice if we determine, in our sole discretion, that you have violated these Terms or any applicable law or regulation.

10 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Highclere Trust is registered. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction, unless otherwise agreed in writing.
